Tahoe Rental Company – Rental Agreement

Reservations:  Thank you for choosing the Tahoe Rental Company for your vacation rental. To confirm your reservation, a deposit of 25% of the total Booking Charge is required, as well as this signed Rental Agreement. The balance of the Booking Charge is due 45 days prior to your arrival date. If your arrival date is less than 45 days from the date you reserve the total Booking Charge is due immediately and the payment and Rental Agreement must be received within 48-hours of making your reservation. The total Booking Charge includes: 1) rent, 2) a non-refundable cleaning and inspection fee, 3) Administration fee 4) Rental Unit Damage Protection Plan or security deposit, 5) Transient Occupancy Tax (TOT), which is 10%-12% of the rent (depending on county).

Forms of Payment: Tahoe Rental Company accepts Discover, MasterCard and Visa cards, as well as e-checks. Checks made payable to Tahoe Rental Company are also accepted, but must be received according to the timetable outlined below. If you are using a credit card for the deposit, the outstanding balance will be charged to the same credit card used for the deposit, unless you make other arrangements prior to the due date of your final payment. If you are paying by check, the deposit must be received within 48 hours of making the reservation and final payment must be received at least seven days prior to the due date to allow for processing. If your arrival is less than 45 days from the date you reserve, the total rental price is due immediately and payment must be received within 48-hours of making your reservation. A credit card must be on file with Tahoe Rental Company to be used in the case of damages above and beyond what is covered by the Rental Unit Damage Protection plan included with this booking.

Cancellation Policy/Refunds: All reservations are unconfirmed until Tahoe Rental Company receives a signed copy of the Rental Agreement. This signed document must be returned within 48 hours of booking. To cancel this reservation, Notice of Cancellation must be received in writing within 45 days prior to the check-in date. If Notice of Cancellation is received (in writing) within this specified time, then Tahoe Rental Company will refund the Guest(s) the amount paid minus 10% of total booking, excluding any travel insurance payments.

If the Guest(s) cancel less than 45 days of the check-in date, then 100% of the Booking Charge is forfeited.

There are no refunds for poor snow conditions, severe weather, smoke, fire, late arrivals, early departures, travel conditions, road closures, allergies, health or medical issues, utility or water outages, mandatory evacuation, construction at neighboring properties, war, terrorism, acts of God or other reasons beyond Tahoe Rental Company’s control. Tahoe Rental Company strongly urges you to obtain the optional Vacation Rental Travel Insurance. See below for more information on travel insurance.

Travel Insurance: Travel Insurance: Tahoe Rental Company strongly urges you to obtain the optional Red Sky Mountain Trip Preserver travel insurance. The insurance plan is designed to protect your vacation investment in the event that you must cancel for many unforeseen reasons such as illness, injury, poor traveling conditions, accidents, or involuntary termination of employment. You may review the benefits and Mountain Trip Preserver policy benefits at www.mountaintrippreserver.com. Purchasing travel insurance is not required in order to purchase any other product or service that we have to offer. We may not be licensed to sell insurance, and therefore, we are not qualified or authorized to answer technical questions about the benefits, exclusions, and conditions of this travel insurance or evaluate the adequacy of your existing insurance coverage. The insurance coverage may duplicate existing insurance policies that you may have. You may wish to compare the terms of this policy with your existing life, health, home, rental and automobile policies, and other sources of protection. If you have any questions about your current coverage, please call your insurer or insurance agent. FOR MARYLAND RESIDENTS: Please additionally read the following: Your travel insurance is primary to any other duplicate or similar coverages.The Limited Lines Travel Insurance Producer for this travel insurance policy is Arch Insurance Solutions, Inc. located in Hunt Valley, MD; and the carrier of this travel insurance is Arch Insurance Company, whose administrative offices are located in New Jersey. All these disclosures that I just read to you along with the contact information for both the producer and carrier will be included in your policy or document of coverage and invoice once we finalize the sale.

Property Damage: Included in your Booking Charges is a TRC Damage Protection plan, unless you have opted out. This TRC Damage Protection plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $1,000. Any damages that exceed $1,000 will be charged to the credit card on file. If, during your stay, a renter covered by the rental agreement causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, TRC will cover the renter for the cost of repair or replacement of such property up to a maximum benefit of $1,000. Certain terms and conditions apply.  Full details of the TRC Damage Protection coverage can be found on our website at https://www.tahoerentalcompany.com/trc-accidental-damage-waiver.The TRC Damage Protection plan can be purchased up to, and including at, check-in. The TRC Damage Protection plan is optional. If you wish to decline Damage Protection, please notify our office and a $1000 security deposit will be placed on the credit card on file. Participation in the TRC Damage Protection plan does not negate your responsibility for damages. You are responsible for all damages that are outside normal wear and tear, missing items, extraordinary cleaning, plumbing stoppages or other damages to the home. By signing this Agreement, you authorize Tahoe Rental Company to charge your credit card to cover any costs in excess of the maximum benefit of $1000 allowed under the policy.  If the cost of replacement, repairs or cleaning exceeds your credit card limit, you agree to pay the difference to Tahoe Rental Company.  In the event of a dispute concerning a security deposit, arguments are to be heard in the jurisdiction where the Property exists.

Check-In: Check-in time is 4:00 pm. You will be sent check-in instructions prior to your arrival. Access and addresses will only be provided if you are paid in full and we have a signed Rental Agreement on file. Early arrivals may include additional fees. 

Check-Out: Check-out time is 10:00 am. Because the time between your departure and the arrival of the next guests is limited, a minimum fee of $150 per half hour will be assessed for unapproved departure times after 10:00 am. Please follow the check-out procedures listed within the binder provided in the rental unit. A $25 per item fee, in addition to the actual cost of replacement, will be charged for lost keys, garage door openers, parking passes, HOA passes, etc., so please be sure all are accounted for before your departure.

Pets: Unless you are renting a Pet Friendly property and have received permission to bring a pet, pets are not allowed in, at, or around the rental property. If you violate the No Pets policy, your entire group will be evicted immediately and all payments will be forfeited. An additional pet fee will be charged to the credit card on file or taken from your security deposit (if applicable).  If you are renting a pet-friendly property, failure to communicate that you are bringing a pet or pay the $112 per pet, pet fee will result in an additional $250 fee, which will be charged to the credit card on file or taken from your security deposit.

Smoking: All our rental properties are non-smoking properties. If evidence of smoking is found after check-out, an additional deep cleaning fee will be charged to the credit card on file or taken from your security deposit (if applicable).

Cleaning: Guest(s) acknowledge that the property is in good order and repair, unless otherwise indicated within two hours of check-in. The Booking Charge includes the inspection and cleaning of the rental upon departure. It is required that the property be left in the same condition you received it by cleaning the kitchen (having the last load in dishwasher) and disposing of all trash in an appropriate bear proof receptacle. The Cleaning and Inspection fee will provide for vacuuming, dusting, sanitizing and the washing of all linens and towels. Guest(s) credit card will be charged for any extra cleaning (at a rate of $65/hour), damages (including stains), excessive trash, and/or loss of inventory.

Number of Guests: The number of guests allowed is noted on the home description. The county has a very strict occupancy guideline. Please do not exceed the number of occupants advertised for this home. County regulations noted that occupancy is defined as 2 people per bedroom, plus 2 additional people, excluding children under 12 years of age. Homes that have 5 or more bedrooms are never to exceed 12 adults. If, at any time, the number of people, not including children under age 12, exceeds the maximum occupancy, you are in breach of this Agreement. Your entire group may be evicted immediately and all payments will be forfeited. An additional per guest fee will be added to the credit card on file or taken out of security deposit (if applicable). If violations or fines occur, fines will be imposed and charged to the guest.

Parties/Rules & Regulations: The property being rented is in a residential neighborhood or complex with year-round residents living near-by. Parties, excessive noise, rowdy behavior, loud music or other nuisances will not be tolerated. County noise and occupancy ordinances are in effect. Quiet hours are between 9:00 PM and 8:00AM. Please note that noise carries easier and further at higher elevations. If the subject property is a condominium, Guest(s) agree to abide by all Rules & Regulations including, but not limited to, rules with respect to noise, odors, disposal of refuse, parking, and use of common areas. Violation of any rules and regulations will be deemed a material breach of this rental agreement and may result in immediate eviction without refund. If violations or fines occur, fines will be imposed.

Hot Tub: If subject property includes a hot tub, Guest(s) acknowledge that the hot tub and surrounding patio/deck can be dangerous; that the deck/patio can be slippery when wet and that injury is likely to occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the hot tub and deck/patio areas. Misuse of hot tub resulting in a dump and scrub will be an additional fee. Outdoor hot tubs may NOT be used from 9:00PM to 8:00AM, per county ordinance. If violations or fines occur, fines will be imposed and charged to the guest.

Maintenance: Tahoe Rental Company will conscientiously try to address maintenance issues as they occur. If an issue occurs that cannot be fixed in a reasonable amount of time, and it significantly affects the Guest(s) stay, Tahoe Rental Company reserves the right to refund at their discretion or relocate Guest(s) to another property. Home Owner Associations: Tahoe Rental Company cannot guarantee amenities provided through homeowner associations, including, but not limited to pools, hot tubs, clubhouses, tennis courts, golf facilities, picnic, and beach facilities, etc.

Parking: Maximum number of parking spaces is limited. If at any time, the number of vehicles exceeds the parking availability listed for this property, you are in breach of this Agreement. Please note the county ordinance for renters does not allow on-street parking; you will be ticketed and/or towed and/or fined. If violations or fines occur, fines will be imposed directly to the renter.

Snow Removal: You are responsible for shoveling necessary walkways during your stay. Snow removal of the driveway is provided for each property; however Tahoe Rental Company does not control the snow removal operators. When plow trucks are outside, please move vehicles from the driveway to facilitate snow removal. If cars are left unattended in the driveway, the operator may skip the home, rather than risk damage to the property. Snow shovels are provided with each property.

Trash Removal: All trash is to be kept inside the home or in the locked metal container called a “Bear Box” in the driveway. Trash must be placed in the “Bear Box” the night before the trash pickup is to take place. The date of pickup will be provided at check-in. Excessive trash fees may apply. Please depart with your excess trash to avoid fees. 

Heat: For your comfort, please feel free to set the thermostat at a cozy temperature while in the home.  When you leave, please set the thermostat back to 55°F to conserve energy.  

Allergies: Please let Tahoe Rental Company know at the time of booking if there are any concerns regarding allergies.  Although Guest(s) are not allowed to have pets in most homes, the property owners themselves may keep a pet.  Please do not assume that the no pets rule means that the home is allergen-free.

Telephones/Internet: Most properties are equipped with a telephone to be used for local calls only. Tahoe Rental Company is not responsible for the operation or maintenance of DSL or other high-speed Internet services. Services are not guaranteed.

Linens and Towels: Rental properties include blankets, bed linens, and one set of towels for each guest up to the maximum number of guests allowed (Towels for beach, pool or spa are not included. Please bring these from home.) For convenience, nearly all of our properties have a washer/dryer.

Household Supplies: Kitchens are well equipped for meal preparation and serving.  There are sufficient dishes, glasses, mugs, tableware and serving dishes for the maximum occupancy. Dishwashing soap and dishwasher detergent are provided. There is a starter amount of hand and bath soaps, toilet paper, paper towels and trash bags to get started, however, more may need to be purchased depending on usage.

Fireplaces and Wood Stoves: Please place ashes in the metal bucket if the fireplace gets full.  Do not throw ashes in the trash as embers remain hot for long periods of time and can be a fire hazard. Call our office if you have any questions about how to use the fireplace/woodstove.

Outdoor fire areas and fire pits: Outdoor fire areas and fire pits prohibited at this home location and in the Tahoe area. 

County Ordinance and Fines: Whether you have rented in Placer County or El Dorado County, please note that fines may be imposed for any violation of the ordinance. El Dorado County reads: Should any violation of the STR/VHR ordinance occur, fines may be imposed in accordance with El Dorado County Municipal Code (§5.56.180 and §5.56.190) and Placer County Code. 

Upon Leaving: Do not turn the heat off. The risk of pipes freezing is significant, which will cause extensive and expensive damage to home.  Guest(s) are responsible for any negligence in this regard. Check that all doors and windows are closed and locked. Keys must be returned to our office (or placed in lockbox on the property); Failure to return keys to our office will result in a $25 charge, plus the cost of replacement.

PERSONAL INJURY/LIABILITY/INDEMNIFICATION: The owner and Tahoe Rental Company shall not be liable for any damage or injury occurring on or about the Premises to Guest, Guest’s family members, Guest’s invitees, except in the case of owner or Tahoe Rental Company’s failure to perform, or negligent performance of, a duty imposed by law. You as a Guest, on behalf of yourself, members of your party, and all of the successors, assigns and heirs, hereby agrees to protect, defend, indemnify and hold harmless the Property Owner and Tahoe Rental Company, its employees, owners and other agents or representatives thereof, from and against any and all losses, costs, expense, damage, or liability (including reasonable attorneys’ fees) arising out of any accident or other occurrence on the Premises or any part thereof, or in any common area, causing injury to any person or property whomsoever or whatsoever, no matter how caused, except in the case of the Owner or Tahoe Rental Company’s failure to perform or negligent performance of a duty imposed by law. The Owner or Tahoe Rental Company is not responsible for damage to Guest’s personal property resulting from fire, storm, rain, flood, power outage, appliance failure, theft, vandalism, leaking fixtures, acts of God, etc. Tahoe Rental Company shall not be liable for negligence or unlawful acts of the owner.

Assumption of Risk: Tahoe Rental Company is acting as a property management agent solely for the Property Owner and your rental agreement is a binding contract between you and the Property Owner. By signing the rental agreement and/or credit card form, you warrant that you are legally capable and authorized to make charges to this account. The laws of the State of California shall govern this contract. Any legal action shall take place in the County in which the Property is located.

Acknowledgement: The undersigned has read and agrees with the terms and conditions of the entire Agreement and accepts all liability for any damage beyond normal wear and tear during the reservation with Tahoe Rental Company. I further understand that I am liable for any missing items, excess cleaning, holding over, or any fines that I incur during my occupancy, and those fees/fines will be billed to my credit card or taken from my security deposit (if applicable).

*Tax rates and county assessments are calculated as of the time of this Agreement. Guests shall be responsible for payment or all applicable taxes and assessments according to rates in effect at the time of occupancy.
